The Challenges of the Correctional Systems in Latin America and the Contribution of the Ombudsman Offices

Resumen
Abstract
One of the main problems that historically have caused a negative impact on the administration of justice in the region has been the penitentiary and prison system. This investigation aims to identify the main problems that arise in the prison systems of the region that has caused serious violations of fundamental rights of people who have been deprived of their liberty and impeding the work of prison officials. It also analysis the rights of persons deprived of liberty and some of the strategies and best practices in the promotion and protection of human rights of persons deprived of liberty, implemented by the Ombudsman in Latin America.
Resumen
Uno de los principales problemas que históricamente ha afectado de manera negativa la administración de justicia en la región latinoamericana ha sido el sistema penitenciario y carcelario. Este trabajo pretende identificar los principales problemas que se presentan en los sistemas carcelarios de la región, los cuales están colapsados y esto ha traído aparejado graves violaciones a derechos fundamentales de las personas privadas de libertad y han dificultado la labor de control de los funcionarios penitenciarios. Luego se hace un análisis de los derechos de las personas privadas de libertad y finalmente se presentan algunas de las estrategias y buenas prácticas implementadas por los Ombudsman de América Latina para mejoramiento en los sistemas penitenciarios.
